These Terms of Service ("Terms") govern your use of the Follow Up Email application (the "App") provided by Klax Holdings LLC ("we," "us," or "our"). By installing or using the App, you agree to these Terms.
Follow Up Email is a Shopify application that enables merchants to send automated email marketing campaigns to their customers, including abandoned cart recovery emails, win-back campaigns, post-purchase emails, and other automated follow-up sequences.
To use the App, you must have an active Shopify store and agree to Shopify's Terms of Service. You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business.

You agree not to use the App to send spam, unsolicited commercial email, or any content that is illegal, harmful, or violates the rights of others.
The App offers a free tier and paid subscription plans. Paid plans are billed through Shopify's billing system and are subject to Shopify's billing terms. Subscription fees are charged on a recurring monthly basis. You may upgrade, downgrade, or cancel your subscription at any time through the App or your Shopify admin. Refunds are handled in accordance with Shopify's partner billing policies.
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You acknowledge that we will process data from your Shopify store (including customer data) as necessary to provide the service.
The App, including its code, design, and content, is the intellectual property of Klax Holdings LLC. You are granted a limited, non-exclusive, non-transferable license to use the App for your own business purposes. You may not copy, modify, distribute, or reverse engineer any part of the App.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or that any specific results will be achieved through your use of the App, including revenue from recovered carts or campaigns.
To the maximum extent permitted by applicable law, Klax Holdings LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the three months preceding the claim.
You agree to indemnify and hold harmless Klax Holdings LLC from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
You may terminate your use of the App at any time by uninstalling it from your Shopify store. We may suspend or terminate your access to the App if you violate these Terms or if required by Shopify. Upon termination, your data will be handled as described in our Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in accordance with applicable law.
